The Tug-of-War Over CNN Highlights How Flawed American Media Has Become.

Late Thursday, amid swirling speculation regarding an incident at Brown University, CNN’s Kaitlan Collins took to social media, noting the confusion and pointing viewers to her channel's 9pm newscast.

Although the network is hardly a flawless news source, her statement resonated for numerous observers. It remains one of the organizations where you can find grounded and mostly trustworthy reporting – especially during crises like the one unfolding in the vicinity of a New Hampshire storage facility.

An Uncertain State During a Business Struggle

Yet CNN, now 45 years old, finds itself in a uncertain position as two giant media empires compete for ownership of its corporate owner, Warner Bros Discovery.

No matter the result, the fate of CNN has become part of a high-stakes game of business acquisition, not as a question of what helps the news-consuming public.

“Here is one more case of the deep structural problems with origins in many years of regulatory actions,” stated Victor Pickard, writer of “Democracy Without Journalism?” and a media policy professor at the Penn.

The conjecture about the future owner of Warner Bros Discovery – will it be Netflix or Paramount Skydance? – overlooks a larger point.

“It is often framed as a corporate drama with influential figures as the central actors, but there is hardly any discussion of the societal benefit,” Pickard explained.

The Complicating Layer: Donald Trump

The CNN scenario is further muddied by Donald Trump’s longstanding stance about a network he has long portrayed as perhaps his primary “fake news” antagonist.

Recall the shouts of “CNN sucks!” at Trump's rallies, his team's disciplinary withdrawal of reporter Jim Acosta’s press credentials, or his clashes with Collins in White House briefings.

Trump now claims that CNN needs new ownership. Many see this as a desire for ownership that will shield him from criticism and scrutiny. That is one reason why he seems to come down on the side of Paramount Skydance, which has made a hostile bid.

There is a basis to favor that suitor more. For one thing, it is run by David Ellison, son of the ally of Trump Larry Ellison, one of the world’s richest people.

The company, owner of CBS News, also recently installed the right-leaning Bari Weiss, known for her “anti-woke” beliefs, as the top editor of that venerable news network.

An Outcome of Further Instability

Notably, if Netflix prevails, CNN and other cable outlets would first be separated into a separate entity. Such a move could be a welcome development to many at the network, but it’s far from a safe harbor. That arrangement could pave the way for CNN for another sale. There is no finish line.

If you ask Timothy Wu, much of this is illegal, anyway. The influential voice of big tech’s dominance stated that anti-trust laws should disallow both deals.

“Either merger would be bad for the country, and both should be challenged by anti-trust authorities,” Wu argued.

The Fundamental Challenge and a Path Forward

Whatever happens with this particular battle, the bigger problem endures.

“What we have now is a very anti-democratic system, but we ought not succumb to a sense of powerlessness,” Pickard noted. Regulatory choices – originating in the 1930s and 1940s – helped to build this profit-obsessed monster, and different policy decisions can tackle it.

Will that happen in an era where the top communications regulator won’t even affirm that the agency is independent? Overhaul is a distant prospect now, but that doesn’t mean it will never happen.

Policies that support independent news organizations, aid local journalism, finance public media, and prevent the accumulation of media power in too few hands are achievable – they are necessary for a robust democracy.

When it comes to media ownership, larger is not superior. And news organizations like CNN cannot be tools in the most recent merger game.
